Marie Carnap advises in product law at the intersection of public and civil law, particularly in product safety and product liability law. Her clients include national and international manufacturers, importers, and distributors of both consumer (B2C) and non-consumer (B2B) products. One of the main focuses of her consultancy work is the assessment of marketability for products marked with a CE label, such as machinery, toys, or construction products, as well as for non-harmonized consumer products covered by the EU General Product Safety Regulation (GPSR) within the European Single Market, in addition to issues of general product compliance. When German or European market surveillance authorities raise objections, she guides her clients through the official proceedings. In the field of product liability law, she provides comprehensive advice on civil liability and supports clients in assessing potential liability risks. She also takes into account the criminal aspects of product responsibility and shows how to address these legally.
In product-related environmental law, Marie Carnap assists her clients in identifying relevant regulatory obligations and developing compliance strategies to prevent liability risks. In light of the ongoing European harmonization – such as through the EU Batteries Regulation and the new Ecodesign Regulation – the implementation of uniform requirements at the European level is increasingly central to her consultancy. Where necessary, she coordinates cooperations with partner law firms in other jurisdictions. She also places special emphasis on ecodesign law, particularly in conjunction with energy labeling requirements.
