Right to Repair - Implementation in Germany

RIGHT TO REPAIR IS COMING: IMPLEMENTATION INTO GERMAN LAW

The Right to Repair Directive (EU) 2024/1799 is intended to promote the repair of goods throughout Europe.

This will be achieved, in part, through changes to the law governing warranties for consumer purchases. The most significant change in this regard is undoubtedly the one-time extension of the warranty period by one year if the consumer opts for a repair in a warranty claim. In addition, the consumers must be informed in advance of their right to choose between delivery of a defect-free item and repair of the defective item, as well as of the fact that, in the event of a repair, the statute of limitations for warranty claims is extended once by one year.

On the other hand, Sec. 479a et seq. of the German Civil Code (BGB) introduce a completely new right to repair for the product groups listed in Annex II of the Right to Repair Directive; this right exists outside the scope of warranty law and must, in principle, be provided by the producer (cf. for more details our additional blog-posts).

On July 22, 2026, the Act Implementing Directive (EU) 2024/1799 on Promoting the Repair of Goods and Improving the Availability of Advance Directives was published in the German Federal Law Gazette. This ensures that the amendments can enter into force in Germany by the deadline of July 31, 2026.
