What’s changing in 2025: Product safety law

In terms of product safety law, the year 2025 will undoubtedly be shaped by the implementation of the EU Product Safety Regulation (GPSR), as this legal act from general product safety law has only been applicable throughout the EU since 13.12.2024. The GPSR affects the entire law on consumer products (partly also in the harmonized area) and, due to the considerable scope of the reform, will be of immense importance for the entire B2C sector and thus also control the level of consumer protection in the EU.

What’s changing in 2025: Product-related environmental law and supply chain due diligence

In the area of product-related environmental law, 2025 will be characterized at European level by further implementation steps under the EU Battery Regulation, by preparations for the EU Packaging Regulation and probably by the progress of files that have already been initiated. At national level, some legal uncertainty is to be expected for the time being until the new Bundestag and the new federal government take up their work. Further developments relating to the implementation of due diligence obligations in Germany will certainly also depend heavily on the upcoming political developments, although certain lines are likely to be clear due to European legal requirements.

The new Cyber Resilience Act (Regulation (EU) 2024/2847)

On December 10, 2024, the Regulation of the European Parliament and of the Council on horizontal cybersecurity requirements for products with digital elements (Cyber Resilience Act, hereinafter “CRA”) entered into force. As the first European legislation of its kind, it introduces binding cybersecurity requirements for products with digital elements throughout their lifecycle and corresponding obligations for economic operators.

EU Packaging Regulation nears final adoption

On 24.04.2024, the EU Parliament adopted the English trilogue version of the EU Packaging Regulation in its last session before the European elections. The final decision on all other language versions in the EU Parliament and then the Council decision are now imminent. The regulation will then be published in the Official Journal of the EU and is expected to apply in principle from mid-2026.

EU Corporate Sustainability Due Diligence Directive (CSDDD) – What is changing in Germany?

Directive (EU) 2024/1760 on corporate sustainability due diligence was published in the Official Journal of the EU on 05.07.2024 and came into force on 25.07.2024. The EU Member States now have until 26.07.2026 to transpose the new requirements into national law.

Template for a Recall Notice

Art. 36 Regulation (EU) 2023/988 (the so-called EU-Product Safety Regulation – GPSR) is the first to lay down binding requirements for the content and design of recall notices in relation to non-harmonised and harmonised consumer products. Based on Art. 36 para. 3 GPSR, the Commission has now issued Implementing Regulation (EU) 2024/1435, which sets out a template for a recall notice.

New Implementing Regulations on veterinary medicinal products

Regulation (EU) 2019/6 of the European Parliament and of the Council of 11 December 2018 on veterinary medicinal products and repealing Directive 2001/82/EC (VMP-Regulation) is in force in the EU since 28.01.2022. However, the provisions of this Regulation has to be further elaborated in tertiary legislative acts.

Harmonised mandatory disclosures on warranties and guarantees

The so-called EmpCo Directive introduces new regulations on information obligations towards consumers regarding the existence of statutory warranty rights and commercial durability guarantees. Harmonised EU-wide notifications and labelling are now to be introduced here.

German Digital Act comes into force: New momentum for the digitalisation of the healthcare sector?

After being adopted by the Bundestag at the end of 2023 and having been approved by the Bundesrat on 02.02.2024, the Act to accelerate the digitalisation of the healthcare system (Digital Act; DigiG) came into force on 26.03.2024.
